The last will and testament of Jessie Ball duPont dictated creation of the Jessie Ball duPont Religious, Charitable and Education Fund and named four trustees as its governing body — two individual trustees, a trustee appointed by the Episcopal Bishop of Florida, and a representative for the corporate trustee. From 1976 to 2004 the Jessie Ball duPont Fund, in accordance with the will, was governed by four trustees.
In 2003, the trustees petitioned the Fourth Circuit Court of Florida to allow the trustees to expand the number of individual co-trustees from two to five, not disturbing the appointment of the clerical trustee or the selection of the corporate co-trustee. Judge Aaron Bowden granted the petition on October 30, 2003. In January 2005, the Fund convened under a governing body of seven trustees.
